1.Provider and scope

These terms apply to the use of FOUND LOVE on found-love.com, found-love.at and found-love.info.

Detail will follow before launchName or company name and address of the provider (see imprint). [to be added before launch]

FOUND LOVE is a digital matchmaking agency. In Austria the trade of matchmaking is subject to the professional rules for matchmaking agencies (BGBl. No. 434/1987).

Open point (legal review)Whether and how the 1987 rules (written contract, written partner proposals) apply to a purely online platform is not conclusively settled. As a precaution, this draft assumes they apply.

2.What FOUND LOVE provides

  • Creating a profile and a compatibility profile based on your answers.
  • Identity and age verification through a verification service, plus confirmation of email and phone number.
  • Daily partner suggestions with explanations, provided enough suitable people are available – for every adult, regardless of gender identity and orientation, based on mutual search.
  • Messages between people with mutual interest, when both have a plan that includes messages (Premium or Premium+); reporting, blocking and safety features on every plan.

FOUND LOVE does not owe success. A partnership or any particular outcome cannot be guaranteed. If no sufficiently suitable person is available, no suggestion is made.

No success fee is charged for arranging a marriage.

3.Requirements and account

  • Minimum age 18. Age is confirmed during identity verification.
  • Only one account per person; the account is not transferable.
  • Truthful information; we may correct obviously false information or provisionally hide the profile.
  • Receiving suggestions and writing messages is only possible after confirmed identity and adulthood.
  • Login details must be kept secret.

4.Sharing your information with other members

By concluding the contract you agree that FOUND LOVE shows the profile information intended for matchmaking (display name, age, city, rounded distance, photos, profile texts, verification badges, explanation of the suggestion) to other suitable members. Gender identity, pronouns and optional information about your orientation are only shown as far as you have shared them; who you are looking for is never shown.

If you no longer want matchmaking, you are obliged to withdraw this consent – by pausing, hiding or deleting your profile. This is possible at any time in your account.

Open point (legal review)Align the wording of the consent and the obligation to withdraw it with § 6 of the professional rules.

5.Circumstances that rule out a partnership

During onboarding we explicitly ask what rules out a partnership for you (e.g. wanting children, marriage, type of relationship, the other person’s children, smoking) and who you would like to meet and store this information. People to whom such a circumstance applies are not suggested to you.

Open point (legal review)Check whether the digital recording meets the requirement to “ask for and record” under § 6 of the professional rules.

6.Partner suggestions

A suggestion contains the information released by the suggested person, as well as the reasons why you could match and possible points of friction. Every suggestion is stored with timestamp and engine version and can be traced in your account.

Open point (legal review)The professional rules require written, verifiable descriptions of persons with certain minimum details for partner proposals – including religious denomination. FOUND LOVE deliberately does not collect religious affiliation (special category under Art. 9 GDPR). To clarify: can this attribute be omitted “where relevant”, and is electronic form sufficient?
Open point (legal review)The minimum details also include “sex”. Besides woman and man, FOUND LOVE knows non-binary, self-described and “prefer not to say”; gender identity is hidden by default. To be clarified: how can this detail be shown lawfully in a proposal (e.g. only after release, otherwise “not stated”, or explicit agreement in the contract) without contradicting the visibility choice and Art. 9 GDPR?

7.Plans and fees

Currently only the free “Free” plan can be booked. Payments are technically disabled.

“Free” includes a profile, verification, a limited number of suggestions with a basic explanation and mutual interest – but no messages. Messages are part of Premium and Premium+ and are only possible when both sides have one of these plans.

For future paid plans (Premium, Premium+), the contract will set out the following points. They are still open:

  • A fixed term – at most two years (§ 6 of the professional rules); termination rights under § 15 KSchG remain unaffected.
  • A minimum number of partner suggestions during the term, stated as a number.
  • A total fee for all services, stated as a number; for instalments, the information under § 24 KSchG.
  • Renewal: only if the contract expressly sets the deadline for a reminder before renewal (cf. § 6(1)(2) KSchG; OGH 4 Ob 196/23m). No surprising renewal periods.
  • Written form or durable medium and handing over a copy of the contract.
Open point (legal review)Have a lawyer determine the contract model, terms, minimum number of suggestions, prices and renewal rules.

Paid plans never change who is considered a match and do not increase visibility. They only affect the number of suggestions, depth of explanations and additional questions.

8.Cancellation and withdrawal

Consumers have a 14-day right of withdrawal for distance contracts under the Austrian FAGG. Details are on the “Withdrawal” page.

If a contract is concluded outside business premises, a one-week cooling-off period under § 4 of the professional rules also applies.

9.Rules of conduct

The community guidelines apply. In particular, fake profiles, requests for money, scams, harassment, sexual content without consent, hate, advertising, spam and illegal content are prohibited.

10.Moderation, measures and appeals

  • Content and accounts can be reported (also without an account via the point of contact).
  • Automated measures are provisional and reversible: message limits, additional verification, provisional freezing.
  • Final restrictions and bans are decided by someone from our team.
  • Every measure comes with a statement of reasons (Art. 17 DSA); affected people can appeal, and another person decides on the appeal.
Open point (legal review)Set deadlines for decisions and appeals and add information on out-of-court dispute settlement (Art. 21 DSA).

11.Pausing, termination and deletion

You can pause or hide your profile or delete your account at any time. A free account ends upon deletion. Paid plans are subject to the contractually agreed termination rules.

We may terminate the contract for good cause, in particular for serious breaches of these terms – after personal review by our team and with a statement of reasons.

12.Liability

We verify identity and age carefully but cannot be responsible for the behaviour of other members.

Open point (legal review)Draft the liability clause within § 6 KSchG; no blanket exclusions (cf. OGH 7 Ob 217/16m on invalid clauses of a matchmaking agency).

13.Changes to these terms

Material changes are announced in advance. Main services or fees will not be changed to your disadvantage without your consent.

Open point (legal review)Review the amendment clause in light of § 6(2)(3) KSchG and case law on deemed consent.

14.Applicable law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules. Mandatory consumer protection provisions of your country of residence remain unaffected. § 14 KSchG applies to claims against consumers.
